Any reasonable complaints of subject matter or contents will be considered and replied. It is not my policy to get rich from this activity - only to finance my hobby. If my efforts allow you to keep or share a memory, that is good also. I will never give (or share) your name, address, or e-mail to anyone. Period.

EVENT PHOTOGRAPHY LEGAL ISSUES

   I have taken the effort and time to research Laws that would pertain to event photography. I have written a short article about the subject. I am not a lawyer and do not pretend that I have all the answers but what I have written is a good start for "event photographers" who are interested. I have drawn heavily on the book written by attorney Bert Krages and by the respected professional photographer Dan Heller. Since I have not seen an article or book written specifically on the issue of "event photography" I believe was the first of its kind on the Internet.    After my research mentioned above I have formulated the guidelines posted below that will govern all "event" photos seen on the CivilWarP website. Keep in mind that I am human and will do my best to follow the law and my better judgment. Any question or disagreement can be sent to me at

Guidelines on the "use and sale of photos on the CivilWarP website"
Terms used;
"event photo" - a photo taken on public or private property at a reenactment or other publicly attended event where others are freely taking photos without prior permission.
"identifiable person(s)" - a person in the photo that can be identified by a disinterested third party such as a judge or a member of a jury.

1. I will never intentionally publish, share or sell any "event photo" that would embarrass or morally harm the person(s) in the photo or owning property in the photo.
2. I do not take, publish or sell "event photos" where a person(s) "reasonable expectation of privacy" has been violated.
3. I will never sell an "event photo" that depicts an identifiable person(s) to anyone except the people shown or their close associates or family unless given permission by the identifiable person(s) in the photo.
3a. an exception to #3 - news agencies that carry that event type. For example - a photo of a volleyball match with 'Volleyball Monthly'.
4. When selling or sharing an "event photo" I do not convey publishing, reproduction, or commercial rights to anyone without the identifiable person(s) permission (simple personal uses are always permitted and not being discussed here)
4a. an exception to #4 - news agencies that carry that event type have to be given publishing rights. For example - a photo of a volleyball match with 'Volleyball Monthly'.
5. I will refer all buyers of "event photos" to these first five guidelines and require that their purchase agrees with them. I will enclose a copy of these first five guidelines with every purchase.
6. I will remove an "event photo" from my website upon request if it meets ANY of the following criteria.
   A. You point out a very good reason.
   B. You represent a third (or greater) space of the photo.
   C. you are the focal point of the photo (my discretion)
7. When I am at an event and in the process of taking "event photos" I am not engaging in a commercial activity unless I have been contracted or paid to do so. I am a spectator taking photos.
8. Event Photography is not my primary vocation. Event Photography is not my primary source of income. My reason for this activity is common knowledge among the community and has been posted in the articles area.

PHOTO DONATION guidelines

I am happy to donate photos to organizations or groups that promote or engage in reenacting. Many websites have civilwarp photos posted. I like to have my photos seen. Donations of this type are limited to a reasonable number and will be sent at resolutions and sizes commonly used on websites. Any other sizes, resolutions, or effects can be requested and may or may not be granted.

The following is for those who take advantage of others kindness. When CivilWarP donates photos no rights beyond promotional website publishing are conveyed. No indemnification or release is implied or granted. Resale rights, Redistribution rights, Immoral use, Copyright rights, and all other rights are retained by CivilWarP and never conveyed nor implied by the donations.
